An instructor, Kafa’a Abdelzahra Qasim, Head of the Government Contracts Unit at the Technical Institute / Kufa, obtained a PhD in Private Law—Commercial Law for his dissertation entitled

“The Legal Regime of Banking Guarantee Companies — A Comparative Study”

The dissertation was supervised by Prof. Dr. Raghad Fawzi Al-Tai, Assistant Dean for Scientific Affairs at the Faculty of Law / University of Kufa.

The dissertation addressed the study of the legal regime of banking guarantee companies in terms of their legal nature, provisions, institutional organization, the mechanisms of control and supervision over them, and the settlement of disputes arising from their activity. This was done through a comparative study between French and Egyptian legislation and by clarifying how Iraqi law views them.

The study concluded that although banking guarantee companies take the form of a joint-stock company, they possess a special legal nature that requires subjecting them to a specialized legal framework that takes into account the specificity of their financial and credit activity. The study also revealed the presence of a relative legislative gap and a fragmentation in the rules governing this type of company in Iraq.

In conclusion, the dissertation recommended drafting a proposed special law for banking guarantee companies as a comprehensive legislative framework that regulates their activity and operations. This would enhance the efficiency of the credit-guarantee system, strengthen the environment for banking credit, help reduce the credit risks faced by banks, and expand the scope of financing directed toward small and medium enterprises—thereby producing a positive impact on economic development and financial and banking stability.
